1.2 The Competitions are open to all persons aged 16 and over and the age of majority in their country of residence excluding the Promoter's
employees or members of their immediate family, agents or any other person who is connected with the creation or administration of our
Competition/s.
1.3 By checking the ‘I agree to the terms and conditions’ box when you register an account, you acknowledge that you have read, understood, agree with and will comply with all the terms and conditions and you thereby enter into a legally binding agreement between you and us. If you do not agree with any of the terms and conditions you should not accept them. Once you have agreed to these terms and conditions, Your failure to comply with any one or more of them may result in disqualification, account closure, and/or legal action against you as deemed appropriate by us.

2.1 By entering a Competition the entrant ('Entrant', 'you', 'your/s’, ‘User/s’) will be deemed to have legal capacity to do so, you will have read and understood
these Terms and Conditions and you will be bound by them and by any other requirements set out in any related promotional material.
2.2 These Competitions are governed by English Law and any matters relating to the Competition will be resolved under English Law and the Courts of England shall have exclusive jurisdiction.
2.3 In the event that you participate in a Competition online via the APP/ Website, and by accepting these Terms and Conditions you confirm that you are
not breaching any laws in your country of residence regarding the legality of entering our Competitions. The Promoter will not be held responsible for any Entrant entering any of our Competitions unlawfully. The Competition involves competing in Skills based APP games (Q&A, Guess the Sound and other/s)
Users can download the APP via Google Play or Apple’s APP store and Train using the APP. The Skills based APP games (Live Games) are played, a minimum of twice a week Via the APP.
Users can compete in the Live Games by purchasing lives through the Website (www.lastwonstanding.com, www.lastwonstanding.co.uk) and through IAP.
Entrants can purchase 1+ amount of live/s. These live/s can be used to compete in either of the twice weekly Skills based competitions via the APP.
In order to enter a Competition, you will need to register an account with us.
4.1 You can register an account in three ways: either online at www.lastwonstanding.com or www.lastwonstanding.co.uk or Via the APP.
4.2 To register an account you will be asked to provide first name, last name, title, date of birth, mobile phone number and other identifiers that you may have provided at some time.
4.3a you will have at least 1 free life to play in the live games. This free live will need to be used before another free live is awarded to you
4.3b for each Last Won Standing Live game, you can purchase more lives via the website and through the APP which can be used to compete in the live games.
4.3c if you* invite/recommend another user/person/player (*awarder) who downloads and creates a Last Won Standing APP account (**awardee) then you will receive 1 free life/s to use for the most recent live game after being awarded said life/s. Each recommended user/person/player (awardee) must input your (awarder) details into the correct field when they make their Last Won Standing account for you to receive your free life/s. You (awarder) can only receive 1 free life for a maximum of nine times. Resulting in a maximum of 9 free lives.
4.4 you will be able to use said lives to compete in the live games which are played at least twice a week via the APP
4.5 you will compete in either the ‘Q&A’, ‘Guess the Sound’ or ‘other’ skills based games.
4.6 you will be able to update your personal data within your account
4.7 you have the opportunity to cancel your registration with LWS at any time. Any lives purchased and unused are non-refundable and will be deleted upon termination of your account.
4.8 please refer to our privacy policy for any further information required
4.9(i) we take absolutely no responsibility for any third party accessing Your Account using the correct Username and password and we shall not be liable for any losses incurred by you as a result of such an event. Any access to Your Account with the correct Username and password will be considered by us as valid.
(ii) Should you become aware of any unauthorized use of Your Account, you are obliged to immediately notify us and we will suspend your Account pending further investigation of such unauthorised use. To help prevent un-authorized account use, we recommend that you do not use any functionality which saves your password for you.
Live competitions are played a minimum of twice weekly (Wednesday & Saturday) every week throughout the year on a rolling basis.
5.1 Q&A game will last for 4 minutes
5.2 you will need to correctly answer an on-going series of multiple choice general knowledge questions
5.3 you have 10 seconds to correctly answer each question, if you get the answer correct you will score points and move onto the following question. If the 10 second time runs out for any question you will lose a life and move onto the following question.
5.4 the faster you answer correctly the more points you will win for that question.
5.5 if you answer incorrectly you will lose a life and move onto the following question.
5.6 once you have exhausted all of you lives and you get a question wrong you are out of the game and your total score is recorded into the database until all players have finished or the game time comes to an end.
5.7 if you are still competing in the game and the game time comes to an end your total score is saved into the database and any remaining lives used for that game are lost.
Live competitions are played a minimum of twice weekly (Wednesday & Saturday) every week throughout the year on a rolling basis.
6.1 guess the sound game will last for 4 minutes
6.2 you will need to correctly identify the played sound from the choice of multiple choice answers, if you identify the correct sound you will achieve points and move onto the following sound. The faster you answer the more points you will win for that sound.
6.3 you have 15 seconds to correctly answer each sound, if you get the answer correct you will score points and move onto the following sound. If the 15 second time runs out for any sound you will lose a life and move onto the following sound. You have 15 seconds of time (within the 4 minute game time) to play and replay each sound until you think you know what the correct answer is.
6.4 the faster you answer correctly the more points you will win for that sound.
6.5 if you answer incorrectly you will lose a life and move onto the following sound
6.6 if the 15 second timer runs out you will lose a life and move onto the following sound.
6.7 once you have exhausted all of your lives and you get a sound wrong you are out of the game and your total score is recorded into the database until all players have finished and the game time comes to an end.
6.8 if you are still competing in the game and the game time comes to an end your total score is saved into the database and any remaining lives used for that game are lost.
Live competitions are played a minimum of twice weekly (Wednesday & Saturday) every week throughout the year on a rolling basis.
7.1 BP game will last for 4 minutes
7.2 you will need to place blocks on to the grid to score points
7.3 if you join a horizontal or vertical line of blocks then those blocks will disappear freeing up more space on the grid to place the blocks
7.4 the blocks selection will be selected in threes each time
7.5 if you are unable to place any one of the three blocks then the grid will reset and the game will continue as long as you have lives. If you have run out of lives then the game will come to end and your score will be recorded.
7.7 if you are still competing in the game and the game time comes to an end your total score is saved into the database and any remaining lives used for that game are lost.
8.1 The prize fund is an estimate of the actual amount players will win.
8.2 (i) Entrant with the highest score will win 70% of the prize fund.
(ii) Entrant with the second highest score will win 20% of the prize fund.
(iii) Entrant with the third highest score will win 10% of the prize fund.
(iiii) All remaining entrants will not win a prize.
8.3 we believe in Fair Play, hence there are no wagering requirements on any of our prizes or offers.
8.4 All fees and prizes are in pound sterling (GBP).
8.5 Your participation in the live and training games is at your sole discretion and risk. By accepting these terms and conditions you agree that you do not find the services we provide through our website and/or software offensive, unfair or questionable. You also acknowledge that we are unable to provide you with any legal advice or assist you with any Legal queries related to the legality of participation in our training or live games or any aspect of our website and/or software.
8.6 We reserve the right to restrict access to all or certain parts of the Site/APP in respect of certain jurisdictions.
8.7 By using our website and/or software you agree to these terms and conditions and any other terms or conditions that we see fit to impose from time to time.
8.8 In the event that live game entrants score the same amount of points (tie) in any live game the prizes will be distributed as follows:
(A) IF three or more live game entrants (they) get the same highest score, then they will share 100% of the prize fund in equal amounts. All remaining entrants for this game who score below the highest score will not win a prize.
(B) IF two live game entrants (said) get the same highest score, then said entrants will share 90% of the prize fund in equal amounts. The next entrant/s who scores closest to the highest score will win/share the remaining 10% of the prize fund. All remaining entrants for this game will not win a prize.
(C) IF two or more live game entrants (they) get the same second highest score and (section 8.8 (A) and (B)) are not valid, then they will share 30% of the prize fund in equal amounts. All remaining entrants will not win a prize.
(D) IF two or more live game entrants (said) get the same third highest score and (section 8.8 (A) and (B) and (C)) are not valid, then said entrants will share 10% of the prize fund in equal amounts. All remaining entrants will not win a prize.
9.1 The Winners will be required to send a copy of their: passport/driver’s license/ up to date utility bill clearly showing name and address/bank statement or alternative proof of identity to the us to confirm their identity, age and also to prove that if the purchase was made by credit card that the card was legally theirs or that they had authorisation to use it, before any prize will be paid or delivered. Any failure to meet these obligations may result in the Winner being disqualified.
9.2 All Winners will also be required to provide photographs and/or pose for photographs and videos, which may be used in future marketing and public relations by us in connection with Last Won Standing if requested by us to do so.
9.3 You agree to the use of your name, address, and/or photograph or other likeness, as well as your appearance at publicity events without any additional compensation (save for reasonable travel expenses) and as required by us if you are declared a Winner.
9.3 Following the ending of all live games we will identify the winning players and contact you via either: Voice Call/Text Message/Email/Push Notification to confirm your win and the winning prize amount as soon as we have verified the game result.
9.4 We will pay your prize by way of either: payment into your bank account or hand delivered cheque.
9.5 We aim to process all winning entrants and contact them within the first hour after a live game has ended.
10.1 The Promoter makes no representations or warranties as to the quality/suitability of any of the goods or services offered as prizes.
11.1 No responsibility will be accepted for failed, partial or garbled computer transmissions, for any computer, phone, cable, network, electronic or internet hardware or software malfunctions, failures, connections, availability, for the acts or omissions of any service provider, internet accessibility or availability or for traffic congestion or unauthorised human act, including any errors or mistakes. Including incoming phone calls during the live games play, Power Shortages or any other scenarios in which the entrant is unable to compete/start/finish live/training games in the APP/website. We shall use our best endeavours to award the prize for a Competition to the correct Entrant. If due to reasons of hardware, software or other computer related failure, or due to human error the prize is awarded incorrectly, we reserves the right to reclaim the Competition prize and award it to the correct Entrant, at its sole discretion and without admission of liability.
11.2 We reserves the right at our sole discretion to change the date of any competition, if for any reason any aspect of the competition is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of us which corrupts or affects the administration, security, fairness, integrity or proper conduct of the competition. We may in our sole discretion cancel, terminate, modify or suspend a competition, or invalidate any affected entries. In the event that we close a competition/change a date of a competition we will give all paid entrants Lives to play future Live game competitions at our discretion.
13.3 We shall not be liable for any economic or other consequential loss suffered or sustained to any persons to whom an award has been incorrectly made, and no compensation shall be due. We shall use our best endeavours to ensure that the software and website(s) used to operate its Competitions perform correctly and accurately across the latest versions of popular internet, tablet and mobile browsers.
